Terms of Service

By accessing or using GPX XC Analyse (the "Service") you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. These Terms apply to all users, including athletes who upload GPX files and administrators who manage competitions and results.

You may use the Service only for lawful purposes and in accordance with these Terms. You agree not to: • Upload files that contain malware, exploit code, or any content intended to harm the Service or other users. • Attempt to reverse-engineer, scrape, or interfere with the Service's infrastructure. • Impersonate another athlete or upload GPX data that does not belong to you without authorisation. • Use the Service in any way that violates applicable laws or regulations. We reserve the right to suspend or terminate accounts that violate these Terms.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately if you suspect unauthorised access. Accounts are personal and non-transferable. One account per person; do not create accounts on behalf of others without their explicit consent.

You retain ownership of the GPX files and activity data you upload. By uploading content you grant us a non-exclusive, worldwide, royalty-free licence to store, process, and display that content solely to provide the Service to you and other users of the same competition. You represent and warrant that: • You own the rights to the GPX data you upload, or have the athlete's permission to upload it on their behalf (e.g., a coach uploading an athlete's file). • The content does not infringe any third-party intellectual property rights. We do not claim ownership of your data and will not use it for any purpose beyond the Service.

The Service optionally integrates with the Strava API. If you connect your Strava account: • You authorise us to retrieve your activity list on your behalf using read-only OAuth tokens. • Your use of Strava data is also governed by Strava's Terms of Service and Privacy Policy. • We are not responsible for any changes to the Strava API that may affect the integration. You can disconnect your Strava account at any time from your profile page.

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that: • The Service will be uninterrupted or error-free. • Analysis results (speed profiles, lap times, comparisons) are accurate enough for official competitive use. • Data will be preserved indefinitely. GPX analysis is provided for informational and training purposes only. Official competition results are determined by the race organisation, not this Service.

To the fullest extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, loss of profits, or loss of goodwill, arising out of or in connection with your use of the Service, even if we have been advised of the possibility of such damages. Our total liability for any claim arising out of or relating to these Terms or the Service shall not exceed the amount you paid us (if any) in the twelve months preceding the claim.

We reserve the right to modify or discontinue the Service (or any part of it) at any time without notice. We may also update these Terms from time to time. When we make material changes we will revise the "Last updated" date. Continued use of the Service after changes are posted constitutes acceptance of the revised Terms.

These Terms are governed by and construed in accordance with the laws of the jurisdiction in which the service operator is established, without regard to conflict-of-law principles.
